The Revista de Derecho (Law Journal) is a publication of the Law School of the University of Piura. With a multidisciplinary approach, it seeks to thoroughly explore the various branches of law, offering a platform for the critical analysis of issues affecting both the academic and professional spheres.

Committed to academic rigor, the journal is open access, international, double-blind peer-reviewed, non-profit, and publishes original research articles, essays, notes, and comments on jurisprudence, as well as analyses of current issues in the legal field. Through its annual editions, the journal aims to establish itself as a key reference for the legal community, contributing to the development and strengthening of legal thought in Peru and internationally.

Objectives

The editorial focus of this journal is to promote the development of knowledge in the field of Law, through the dissemination of theoretical, legal, casuistic and methodological material on various legal issues and their practical application. Through the publication of original academic works, the journal seeks to contribute to the reflection and advancement of legal disciplines, fostering an intellectual debate that promotes the evolution of the field of law in both academic and professional fields.

Target Audience

With an international reach, it is primarily aimed at academics, researchers, professors, university students, research centers, public and private organizations, and legal professionals in general.

Frequency and Format

The Revista de Derecho is published annually (in December) in electronic format. In this format, the publishing entity adheres to an open access policy, allowing the download, distribution, copying, and printing of published materials without any restrictions. This ensures free and unrestricted access to information, eliminating economic, technical, or legal barriers for all readers. In this way, equitable access to knowledge is promoted, significantly contributing to academic and scientific progress, generating concrete contributions that enrich the field of research and the dissemination of knowledge in the discipline of law.

Research articles, which must be original and unpublished, will be accepted during the specific call (annual) carried out within the period established by the Editorial Board.

In all cases, those interested in submitting their works must strictly comply with the instructions and writing guidelines defined for authors, adapting their manuscripts to the established requirements to ensure the quality and uniformity of the submissions. It is essential that each paper conforms to the editorial guidelines to facilitate its evaluation.

Selection of Manuscripts

Manuscripts will be received and evaluated by the Editorial Board, which will verify their relevance to the theme and focus of the Revista de Derecho. Additionally, a thorough analysis will be conducted regarding the originality, relevance, academic quality, and scientific impact of each manuscript. The Editorial Board will decide whether to accept or reject the submitted articles, notifying the authors of the decision within a timely manner. In case of rejection, authors may request reconsideration of the decision, which will be evaluated again by the same body within ten days from the notification.

Articles and contributions from the entire scientific community, both national and international, are accepted, ensuring free and equitable access for all researchers. There will be no article processing charges (APC) or any other fees associated with submissions. Additionally, there will be no submission fees, promoting the inclusion and open dissemination of scientific knowledge without economic barriers for the authors.

Plagiarism Detection

The Editorial Board and the executive directors of the Revista de Derecho conduct a rigorous review of all manuscripts received to ensure they meet the highest ethical and academic standards, especially concerning plagiarism detection.

The initial control occurs upon receiving the article, where members of the Editorial Board perform a preliminary reading to check for any matches with other publications by the author(s), which helps identify any potential unethical conduct.

Additionally, all manuscripts undergo a thorough review using the Turnitin anti-plagiarism software, which detects similarities in the text as well as potentially plagiarized content, including translated texts, content generated by artificial intelligence, or manipulated content to hide its origin. This process also identifies paraphrased or altered texts meant to avoid detection.

Subsequently, peer reviewers conduct a more detailed evaluation of the articles, following practical guidelines provided by the journal to identify possible plagiarism or lack of originality. During the correction and style editing stage, additional checks are made to verify the integrity of the texts.

If a revised version of a previously published article is submitted, the author(s) must disclose this in the first footnote, and the new version must be properly justified. This justification may include incorporating significant updates or recovering a valuable article previously published in another language that is not part of the journal's languages, among other reasons.

In the event of plagiarism or self-plagiarism being detected, the article will be rejected and returned to the author, along with a detailed justification explaining the infraction. The journal maintains a strong commitment to academic integrity and transparency throughout the editorial process.

Peer Review System

To ensure the highest scientific quality of its publications, the Revista de Derecho implements a double-blind peer review system for all research articles submitted by authors for publication. This process ensures the anonymity of both the authors and the reviewers, fostering greater impartiality and objectivity in manuscript evaluation. The reciprocal anonymity helps eliminate any biases, allowing for a more rigorous and fair analysis of the content.

This system allows the journal to establish a more efficient and effective quality control mechanism, ensuring that articles meet the highest academic standards. It also strengthens the principles of editorial and institutional transparency, as authors can trust that their work will be evaluated objectively without external influence, and reviewers can make their recommendations without fear of repercussions. Additionally, this system promotes constructive feedback, contributing to the refinement of articles before their final publication.

The review process for articles submitted for publication in the Revista de Derecho follows these steps:

  1. Initial Reception and Evaluation: Articles are received and examined by the Editorial Board, which will verify their relevance to the theme and focus of the journal. Additionally, the originality, importance, academic quality, and scientific interest of the work will be assessed. Based on this analysis, the Editorial Board will decide whether to accept or reject the articles. The decision will be communicated to the authors, who may request reconsideration of the rejection within 10 days from the notification.
  2. Compliance with Guidelines: The review process will only begin if the articles comply with the submission guidelines for authors, which are available on the journal's website.
  3. Peer Review (Double-Blind): Articles will be reviewed through the double-blind peer review system. The articles will be sent to two external reviewers selected by the Editorial Board, who will not know the identity of the authors. Likewise, authors will not have access to the identity of the reviewers. To ensure anonymity, the Editorial Board will remove any information that could identify the authors from the manuscripts and their files.
  4. Review by Reviewers: The selected reviewers, upon accepting the review, will evaluate the articles according to the journal's publication standards. They must also maintain confidentiality regarding all aspects of their evaluation. Reviewers will have a maximum of 15 days from their acceptance to submit their report.
  5. Reviewer’s Report: Reviewers will submit a report to the Editorial Board with their recommendation regarding the article. The options include: a) approve publication without modifications; b) approve publication with improvements; or c) reject publication. The decision will be communicated to the author, ensuring the anonymity of the reviewer.
  6. Review of Suggested Changes: If the article is approved with the condition that changes are made, the author will have 15 days to submit the revised version. The author must indicate the changes made or justify why certain suggestions were not implemented. If necessary, the reviewer will verify the corrections within 15 days.
  7. Disagreements between Reviewers: If a disagreement arises between the reviewers, the Editorial Board may assign a third reviewer, whose report will help strengthen the final decision.
  8. Final Decision by the Editorial Board: The Editorial Board will make the final decision about the article's publication, based on the reviewers’ recommendations and their own evaluation.
  9. Publication Dates: In all cases, the dates of receipt and acceptance of the article will be indicated in the relevant publication.

Regarding bibliographic reviews published in the corresponding sections, they will not undergo the peer review process. However, the Editorial Board will perform a strict pre-check of these contents. In specific cases, when depth, length, or complexity justifies it, the Editorial Board may send these works to an external reviewer for evaluation.

This process ensures that the articles published in the Revista de Derecho maintain high standards of academic quality, transparency, and objectivity, contributing to the dissemination of scientific knowledge in a rigorous and ethical manner.

Ethics and Good Editorial Practices

The Revista de Derecho adheres to the Code of Conduct and Good Editorial Practices of the Committee on Publication Ethics (COPE), a forum for discussion among editors of peer-reviewed scientific publications (https://publicationethics.org/core-practices), whose primary goal is to promote the integrity of academic research and its publications. Specifically, it will follow, as applicable, the procedures described in the flowcharts published by this institution.

Policy on Sections

The Revista de Derecho edition consists of two sections:

  1. Research articles: Academic material that presents, in detail, the original results of research projects. The structure of the article should follow the following format: introduction; development; conclusions; bibliography, legislation and jurisprudence cited, annexes and/or appendices.

  2. Book reviews: Recent publications in the field of law. These should include the bibliographic data of the book being reviewed: author/s, year of publication, title of the book, city of publication, publisher and total number of pages of the book. In the case of reviewing a specific chapter within a book, the title of the chapter and the beginning and end pages of the chapter should be added.

The content of the works published is the sole responsibility of the author or submitter. The University of Piura and its academic units assume no responsibility for the authenticity, integrity, veracity, or credibility of the published articles. Authors are solely responsible for ensuring that their research meets the required ethical and academic standards, as well as for the correct citation of sources used. The journal, in its capacity as an academic dissemination platform, is limited to evaluating the works from a scientific and editorial perspective, without assuming responsibility for the content presented by the authors.

Copyright

Authors submitting research or reviews must certify that their works have not been previously published in any medium, either print or digital, and guarantee the University of Piura the right to first publication. Authors also declare that the copyright has not been assigned to any other institution or person, whether natural or legal. The transfer of rights and the license for use will be governed by the following terms and conditions:

PERMITTED USES

By submitting their article or review for publication in the Revista de Derecho, the author grants the University of Piura non-exclusive copyright. This grant includes a free license for reproduction, distribution, publication, public communication, availability, transmission, and/or digital deposit of the article in the Institutional Repository or other reliable sites that allow for digital preservation. The University of Piura, through the Editorial Board, is authorized to make the necessary formal and technical modifications to ensure the proper exercise of these rights and to assign the article to the most relevant section.

GOOD EDITORIAL PRACTICES

The author declares and recognizes under oath, understood to be sworn when creating their user and password in the OJS system of the Revista de Derecho, that they are the author of the article or review submitted and the holder of the copyright granted herein. They also guarantee that they have not entered into any agreements or obligations incompatible with this transfer and that the work is original, unpublished, and created without infringing on third-party rights. Images, quotes, and transcriptions incorporated into the work are properly referenced and authorized by their owners or fall under an exception or limitation of copyright. Additionally, the author guarantees that the work does not contain defamatory statements or violate legal norms.

The author also guarantees that the manuscripts submitted for publication in the Revista de Derecho have not been disseminated previously in any print or digital medium and that they have not transferred the copyright to any other institution or person, natural or legal. If the author permits the publication of their work in other scientific or academic publishers or media after its initial guaranteed publication, they agree to require that it be noted that the work was previously published in the Revista de Derecho, specifying the title, year of publication, volume number, pagination, DOI, and any other information necessary for correct identification.

EXTRATERRITORIALITY AND DURATION

This license will be governed by the legislation of the Republic of Peru and will be valid both domestically and internationally for the maximum protection period granted by current copyright law for the work.

By submitting their contribution, authors grant the Editorial Board the right to reproduce the texts accepted for the Revista de Derecho or other scientific journals, specifically the right to publish them in the print and digital versions of the journal, as well as in databases and other collections where the journal is indexed. Submitting the work implies a commitment not to submit it simultaneously to other periodicals.

Authors retain their copyright and grant the journal the right of first publication of their work, which will be simultaneously subject to the Creative Commons Attribution 4.0 International License, allowing the work to be shared provided the original publication in this journal is properly acknowledged. Authors may adopt other non-exclusive distribution licenses for the published version of the work (e.g., deposit it in a repository or publish it in a monographic volume) as long as the original publication in this journal is acknowledged. Authors are encouraged to disseminate their work online (e.g., in archives, institutional repositories, academic social networks, etc.).
